A Detailed Guide To Cancun & Mexico’s Smoking & Vape Laws in 2025

Planning a trip to the breathtaking beaches of Cancun, the lively streets of Playa del Carmen, or the awe-inspiring Mayan ruins of Tulum? Chances are you’ve heard about Mexico’s change in smoking laws, and you might have some questions about how Mexico’s new smoking laws could affect your vacation.

In 2023, Mexico enacted more stringent smoking laws with the aim of safeguarding non-smokers from second-hand smoke and fostering healthier public spaces. These new rules ban smoking in the majority of public areas, including bars, restaurants, beaches and resorts. Plus they also place restrictions on the import of cigarettes, cigars, and vape products. Cigarettes have specific limits on how many you can safely bring with you without incurring a hefty fee, however electronic cigarettes and vapes are banned entirely. 

This in-depth guide will shed light on the recent legislative changes and their implementation, particularly in Cancun and the rest of the Riviera Maya. Smoking Regulations at Cancun International Airport: Can I Smoke At The Cancun Airport?

Cancun airport, a major gateway for international tourists, has adjusted to the new laws pretty well. You can’t smoke directly in front of most entrance and exit doors. Smoking is now confined to designated areas outside the terminal buildings. This rule is rigorously enforced, so be ready to comply both upon arrival and departure.

Can I Bring Cigarettes Into Mexico?

Yes, you can bring up to 10 packs of cigarettes, 25 cigars or 200 grams of tobacco, provided you are over 18 years of age. More information can be found here. 

What About Vapes or E-Cigarettes?

E-cigarettes and vapes, which have surged in popularity, are also affected by the new laws. According to the UK Foreign, Commonwealth & Development Office, and the Government of Canada, and the U.S. Department of State, it is illegal to fly into Mexico with electronic cigarettes, vaping devices, and vaping solutions.

Electronic Cigarettes (Vaping Devices): It is illegal for travelers to bring electronic cigarettes (vaping devices) and all vaping solutions to Mexico. Customs will confiscate vaping devices and solutions and travelers could be fined or arrested. Avoid delays and possible sanctions by not taking these items to Mexico.

However, certain vendors in Mexico continue to sell these products. Chances are you will still encounter vendors walking by on the beaches, and various smoke shops around Cancun & Playa del Carmen that will still sell these products. Buy them at your own risk. 

Can I Smoke At Hotels & Resorts In Cancun & Riviera Maya?

Hotels and resorts in Cancun and the Riviera Maya have pretty diverse smoking policies. Some have established designated smoking areas for their guests, often situated away from communal areas to avoid affecting non-smokers. Alternatively, some resorts have opted to become completely smoke-free in response to the new laws, prohibiting smoking throughout their premises.

Smoking in Public Areas in Cancun

Cancun, renowned for its beautiful beaches and lively nightlife, has seen a varied response to the new laws. Cancun beaches follow the smoking ban, making it technically illegal to smoke on them. Officials have installed several signs around public beaches – including in Caracol, Defines, and Marlín – stating that the consumption of any type of product containing tobacco or nicotine is strictly prohibited.

Furthermore officials are also sprucing up Cancun beaches by removing cigarette and vape vending machines. 

Although police have been slow to enforce the new laws, tourists and residents that smoke on public beaches in Cancun and the Riviera Maya could face significant penalties, including fines or arrest.

Repeat offenders could be jailed for up to 36 hours, although for now, it remains unclear just how many people have faced sanctions over the new law.

Smoking in Public Areas in Playa del Carmen and Tulum

Traveling south from Cancun, you’ll encounter Playa del Carmen and Tulum, famed for their unspoiled beaches, thrilling tours, and day-trips. Here, the enforcement of the smoking ban is less rigid. Many outdoor areas, such as beaches and parks, still permit smoking, but it’s always considerate to keep a distance from non-smokers.
